Goby Health LLC DBA GobyMeds Terms of Service

These Terms of Service govern your use of the website located at https://www.gobymeds.com, the GobyMeds platform, and the non-clinical technology, administrative, account, communications, order-coordination, and support services made available by Goby Health LLC DBA GobyMeds (“GobyMeds,” “we,” “us,” or “our”). By accessing or using the website, platform, or GobyMeds’ non-clinical services, you agree to these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you must not access or use the website, platform, or GobyMeds’ non-clinical services. We may update these Terms of Service from time to time. Updated Terms will apply prospectively from the effective date stated in the updated Terms, except where applicable law requires otherwise. We may provide notice of material changes through the website, the platform, email, or other reasonable means. The Terms applicable to a particular order are generally the Terms in effect when the order is placed, unless applicable law requires otherwise.

Eligibility

To use the GobyMeds platform or access services through the platform, you must be at least 18 years of age. GobyMeds does not market or offer services to, and does not knowingly collect personal information from, anyone under 18. Access to clinical services through independent medical groups participating in the GobyMeds provider network is available only where the applicable participating provider is licensed, registered, or otherwise authorized to provide care; where the requested service is legally permitted; and where you are physically located at the time of care. Your residence, mailing address, billing address, or shipping address does not determine whether a participating provider may provide care if you are physically located elsewhere at the time of care. You may be required to verify your identity, age, and physical location before receiving services. Eligibility for any treatment, laboratory testing, prescription, or other clinical service is determined solely by the applicable participating provider based on clinical judgment and applicable law, not by GobyMeds, marketing content, checkout pages, intake forms, or administrative screening.

Nature of GobyMeds' Services

GobyMeds provides a technology and administrative platform that supports access to independent medical groups participating in the GobyMeds provider network. GobyMeds does not practice medicine, make clinical decisions, provide medical advice, prescribe medications, dispense medications, operate a pharmacy, or operate a laboratory. Medical care is furnished solely by independent medical groups participating in the GobyMeds provider network and by participating providers. Prescription medications, when prescribed, are dispensed by independent licensed pharmacies. Laboratory services, when ordered, are performed by independent laboratories. Using the platform does not create a provider-patient relationship with GobyMeds. You may not be able to choose the medical group, participating provider, pharmacy, or laboratory involved in your care or order. Assignment may vary based on your physical location at the time of care, the service requested, provider licensure, provider registration or other authorization, pharmacy and laboratory availability, clinical judgment, operational availability, and applicable law. Participating providers, medical groups, pharmacies, and laboratories are independent from GobyMeds and are responsible for their own professional judgment, services, notices, consents, licenses, registrations, and legal obligations.

No Emergency Services
The GobyMeds platform is not for medical emergencies or urgent medical needs. GobyMeds does not provide emergency medical services, emergency medical advice, crisis services, or real-time urgent care. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. Do not delay seeking emergency or in-person medical care because of information available through the GobyMeds platform or because you are waiting for a response from GobyMeds, a participating provider, a medical group, a pharmacy, or a laboratory.

Telemedicine Services
Telemedicine encounters through the GobyMeds platform may include asynchronous questionnaires, secure messaging, phone, video, or other legally permitted technologies. The modality used for a particular service is determined by the applicable participating provider based on your physical location at the time of care, the requested service, applicable law, and clinical judgment. A participating provider may require real-time audio/video interaction, additional information, medical records, laboratory testing, identity verification, location verification, an in-person evaluation, or referral to in-person care before providing treatment, ordering laboratory testing, or issuing any prescription. Submitting an intake form, completing payment, or using the platform does not guarantee that a participating provider will determine that treatment is appropriate, prescribe medication, order laboratory testing, or continue treatment.

Controlled-Substance Services
Certain services, including evaluations involving testosterone replacement therapy or other controlled substances, are available only where legally permitted and only through participating providers who are appropriately licensed, registered, or otherwise authorized. These services may require real-time audio/video interaction, identity verification, age verification, verification of your physical location at the time of care, review of prescription drug monitoring program information where required or clinically appropriate, laboratory testing, medical records, an in-person evaluation, pharmacy verification, or other steps required by law or clinical judgment. A participating provider may decline to prescribe, may require in-person care, may refer you to in-person care, or may discontinue treatment at any time based on clinical judgment or legal requirements. GobyMeds does not prescribe, dispense, or guarantee access to controlled substances.

Compounded Medications
Where clinically appropriate and legally available, a participating provider may prescribe a compounded medication that is dispensed by an independent licensed pharmacy or prepared or supplied by an outsourcing facility, as applicable and as permitted by law. Compounded medications are not FDA-approved, and FDA does not verify their safety, effectiveness, or quality before they are marketed. Compounded medications are not generic versions of, identical to, interchangeable with, or clinically equivalent to FDA-approved brand-name medications. They may differ from FDA-approved medications in ingredients, concentration, additives, dosage form, labeling, instructions for use, storage requirements, and beyond-use date. Availability of compounded medications may change based on applicable law, FDA policy, pharmacy capacity, ingredient availability, provider judgment, or safety considerations. GobyMeds does not manufacture, compound, prescribe, dispense, or guarantee the availability of any compounded medication.

Limitations of Use

By using the GobyMeds website, platform, or related non-clinical services, you agree that you will not:

(a) use the platform for any unlawful, fraudulent, misleading, abusive, or unauthorized purpose;

(b) create an account, submit an intake form, request services, or place an order using false, inaccurate, incomplete, or misleading information;

(c) impersonate another person, use another person’s identity or payment information, or seek medical services or prescription medication for anyone other than yourself unless a legally authorized process expressly permits it;

(d) misrepresent your age, identity, medical history, medication history, allergies, laboratory results, symptoms, physical location, shipping address, or payment information;

(e) seek, obtain, divert, transfer, resell, share, or misuse prescription medication in violation of law, pharmacy instructions, provider instructions, or these Terms;

(f) interfere with, disrupt, damage, reverse engineer, decompile, copy, scrape, crawl, harvest data from, or attempt to gain unauthorized access to the website, platform, systems, accounts, networks, software, security features, or data;

(g) use the website or platform to transmit or publish unlawful, fraudulent, harassing, threatening, defamatory, obscene, invasive, or otherwise objectionable material;

(h) use the website or platform to send unauthorized advertising, spam, malware, or other harmful code;

(i) infringe or violate the privacy, intellectual property, publicity, contractual, consumer-protection, or other rights of GobyMeds or any third party; or

(j) use the website, platform, or related services in any way that violates applicable law, these Terms, any applicable consent, provider instruction, pharmacy instruction, laboratory instruction, or other policy referenced by GobyMeds.

Intellectual Property

The website, platform, software, functionality, designs, text, graphics, logos, trademarks, service marks, compilations, content, and other materials made available by or on behalf of GobyMeds, excluding content owned by third parties and User-Generated Content, are owned by GobyMeds or its licensors and are protected by applicable intellectual property and other laws.

Subject to your compliance with these Terms, GobyMeds grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the website and platform solely for your personal, lawful, non-commercial use in connection with obtaining information about or accessing services through the platform.

Except as expressly permitted by applicable law or these Terms, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, transmit, sell, license, exploit, or otherwise use any portion of the website, platform, or content without prior written permission from the applicable rights holder.

All rights not expressly granted in these Terms are reserved by GobyMeds and its licensors. The license granted under this section automatically terminates if you violate these Terms and may be suspended or terminated by GobyMeds as permitted under these Terms.

User-Generated Content

You may submit information, content, communications, responses, forms, documents, photographs, identification materials, laboratory information, medical information, feedback, reviews, and other materials through the website or platform (“User Content”). As between you and GobyMeds, you retain ownership of any intellectual property rights you hold in your User Content.

You grant GobyMeds a non-exclusive, royalty-free, worldwide license to host, store, reproduce, transmit, process, use, and disclose User Content as reasonably necessary to: (a) operate, maintain, and improve the website and platform; (b) facilitate services requested by you; (c) communicate with you; (d) transmit information to independent medical groups participating in the GobyMeds provider network, participating providers, pharmacies, laboratories, service providers, and vendors involved in providing requested services; (e) comply with legal obligations; and (f) otherwise act in accordance with our Privacy Policy and applicable law.

You represent and warrant that you have all rights necessary to provide the User Content you submit and that your submission of User Content does not violate applicable law or the rights of any third party.

You are solely responsible for the accuracy, completeness, and legality of the User Content you provide. Nothing in this section transfers ownership of your User Content to GobyMeds.

Payment and Billing

GobyMeds operates on a single-payment-per-order basis. Unless expressly stated otherwise at checkout, payment is due at the time an order is placed. GobyMeds does not currently offer subscriptions, memberships, automatically recurring billing, or automatic renewals. To request additional services, evaluations, laboratory testing, or medication, you must submit a new order and complete any required intake or clinical review process.

Prices displayed through the platform are subject to change before an order is placed. Pricing may vary based on the service requested, medication prescribed, dosage, formulation, applicable dispensing pharmacy, laboratory services ordered, shipping requirements, applicable taxes, or other factors disclosed during the ordering process.

Payment for an order does not guarantee that a participating provider will determine treatment is appropriate, issue a prescription, order laboratory testing, continue treatment, or approve any requested service. Clinical decisions are made solely by the applicable participating provider.

GobyMeds does not accept health insurance for orders placed through the platform unless expressly stated otherwise. You are responsible for all charges associated with your order. Cancellations, refunds, and any applicable consultation fees are governed exclusively by the Order Cancellation Policy and Refund Policy set forth in these Terms.

Communications; SMS/MMS/RCS and Email

GobyMeds and service providers acting on our behalf may send you transactional, operational, administrative, service-related, account-related, security-related, order-related, laboratory-related, shipping-related, customer-support, and care-coordination communications by email, telephone, SMS/MMS text message, RCS message, secure message, or other reasonable means, to the extent permitted by applicable law. These communications may include account verification messages, identity-verification requests, appointment-related communications, care-coordination communications, order updates, prescription-status updates, shipping notifications, laboratory-related communications, customer-support communications, security alerts, and other information related to your use of the platform or requested services. Transactional and service-related communications are not marketing messages.

GobyMeds may also offer optional marketing messaging programs, including “GobyMeds Marketing Alerts.” If you separately opt in, you authorize GobyMeds and service providers acting on its behalf, to send recurring marketing or promotional emails and SMS/MMS/RCS messages to the email address or telephone number you provide, including messages sent using an automatic telephone dialing system or other automated technology. GobyMeds Marketing Alerts may include promotional messages, offers, reminders, cart reminders, service information, and other marketing content from GobyMeds.

Consent to receive marketing messages is not required to purchase any goods or services. Agreement to these Terms of Service does not constitute consent to receive marketing or promotional SMS/MMS/RCS messages. Any marketing SMS/MMS/RCS opt-in checkbox or equivalent opt-in control presented by GobyMeds will be separate from acceptance of these Terms and will not be pre-checked.

GobyMeds may also offer account-notification messaging programs, including “GobyMeds Account Notifications,” for non-marketing account, order, security, service-related, and care-coordination messages. Message frequency varies by program. Message and data rates may apply. Wireless carriers are not liable for delayed or undelivered messages.

You may opt out of marketing SMS/MMS/RCS messages at any time by replying STOP to the applicable message. After you send STOP, GobyMeds or its messaging provider may send one final message confirming that you have been unsubscribed. After that, you will no longer receive marketing SMS/MMS/RCS messages from that program unless you opt in again. Reply HELP for help, or contact GobyMeds customer support at customersupport@gobymeds.com.

You may unsubscribe from marketing emails by using the unsubscribe link included in the email or by contacting GobyMeds customer support. Marketing email opt-out requests will be processed within the time required by applicable law.

Opting out of marketing communications does not prevent GobyMeds from sending legally permitted transactional, operational, administrative, account-related, security-related, order-related, laboratory-related, shipping-related, customer-support, care-coordination, or other non-marketing communications related to your account, order, requested services, or use of the platform.

GobyMeds does not sell or rent your mobile opt-in data or text-message consent information. GobyMeds does not share mobile opt-in data or text-message consent information with third parties for their own marketing or promotional purposes. GobyMeds may use service providers, messaging vendors, wireless carriers, aggregators, and other vendors as needed to operate messaging programs, process consent and opt-out requests, deliver messages, maintain records, and comply with law.

Additional terms governing SMS/MMS/RCS messaging programs are set forth in the GobyMeds SMS Terms located here [LINK: SMS Terms page] and Privacy Policy located here, each of which is incorporated into these Terms by reference.

Laboratory Testing Services

Certain services available through the GobyMeds platform may involve laboratory testing. Laboratory testing is ordered, when clinically appropriate, by the applicable participating provider or independent medical group participating in the GobyMeds provider network, and is performed by independent laboratories, collection sites, or other laboratory service providers that are licensed, certified, registered, or otherwise authorized as required by applicable law. GobyMeds does not operate a laboratory, collect or test specimens, interpret laboratory results, diagnose conditions, or determine whether laboratory testing is clinically appropriate.

GobyMeds may provide non-clinical administrative and technology services related to laboratory testing, such as facilitating intake, payment, lab-order transmission, scheduling or kit coordination, communications, and access to results through the platform where available. You may not be able to choose the laboratory, collection site, specimen-collection method, or laboratory service provider. Availability and assignment may vary based on your physical location, the requested service, participating provider judgment, laboratory availability, specimen type, shipping or collection requirements, and applicable law.

A participating provider may require laboratory testing before prescribing medication, continuing treatment, changing a dose, or determining whether treatment is appropriate. Submitting information, paying for an order, or completing laboratory testing does not guarantee that a participating provider will prescribe medication, continue treatment, change a dose, or determine that any requested treatment is appropriate. You are responsible for following instructions provided by the participating provider, laboratory, collection site, or pharmacy, including instructions for fasting, specimen collection, timing, shipping, and follow-up.

Laboratory results and related records may be maintained by the applicable independent medical group, participating provider, laboratory, collection site, or their respective systems, and may also be made available through the GobyMeds platform as permitted by applicable law and applicable privacy practices. Additional laboratory consents, notices, policies, or terms from independent laboratories, collection sites, or participating providers may apply.

Patients residing in New York and New Jersey have the right under their respective state patient billing laws to request an itemized price list from GobyMeds for their laboratory tests.

This disclosure does not mean that GobyMeds performs laboratory testing or operates a laboratory.

Liability

To the fullest extent permitted by applicable law, the GobyMeds website, platform, content, communications, and non-clinical administrative and technology services are provided on an “as is” and “as available” basis. GobyMeds disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, title, availability, security, accuracy, completeness, uninterrupted operation, and error-free operation.

GobyMeds does not warrant or guarantee that the website, platform, content, communications, order coordination, laboratory-related coordination, pharmacy-related coordination, customer support, or other non-clinical services will result in any diagnosis, treatment, prescription, medication, laboratory test, refill, shipment, delivery, clinical outcome, or particular result. GobyMeds is not responsible for independent clinical judgment, professional services, pharmacy services, laboratory services, carrier services, or other services provided by independent medical groups, participating providers, pharmacies, laboratories, collection sites, carriers, or other independent third parties, except to the extent required by applicable law.

To the fullest extent permitted by applicable law, GobyMeds and its owners, officers, directors, employees, contractors, agents, licensors, vendors, and service providers acting on GobyMeds’ behalf in connection with GobyMeds’ website, platform, or non-clinical services will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, or for lost profits, lost revenue, loss of data, loss of goodwill, loss of use, business interruption, or other intangible losses, arising out of or relating to these Terms, the website, platform, content, communications, orders, or non-clinical services, whether based on contract, tort, negligence, strict liability, statute, or any other legal theory, even if GobyMeds has been advised of the possibility of those damages.

To the fullest extent permitted by applicable law, GobyMeds’ total liability for any claim arising out of or relating to these Terms, the website, platform, content, communications, orders, or GobyMeds’ non-clinical services will not exceed the greater of: (a) the amount you paid to GobyMeds for the specific order giving rise to the claim; or (b) one hundred dollars ($100).

Nothing in these Terms excludes or limits liability to the extent liability cannot lawfully be excluded or limited, including liability arising from GobyMeds’ gross negligence, willful misconduct, or violation of non-waivable consumer-protection, privacy, healthcare, pharmacy, laboratory, or other rights under applicable law.

Accuracy of Platform Information

Information made available through the GobyMeds website or platform, including educational materials, medication descriptions, treatment descriptions, eligibility information, pricing information, order information, pharmacy-related information, laboratory-related information, frequently asked questions, and other content, is provided for general informational and administrative purposes only. It is not medical advice, diagnosis, treatment, a prescription, pharmacy advice, laboratory interpretation, or a substitute for professional medical judgment.

GobyMeds may receive or display information from independent medical groups participating in the GobyMeds provider network, participating providers, independent licensed pharmacies, independent laboratories, vendors, and other third parties. GobyMeds makes reasonable efforts to support accurate platform information, but information displayed through the website or platform may be incomplete, inaccurate, unavailable, out of date, or subject to change.

Medication-related information displayed through the website, platform, checkout process, or order pages, including information about ingredients, additives, concentration, dosage form, volume, quantity, packaging, storage, shipping conditions, and beyond-use date, may vary based on the medication actually prescribed, the independent licensed pharmacy dispensing the medication, pharmacy availability, applicable law, provider judgment, safety considerations, and other operational or clinical factors. Images, descriptions, and examples are illustrative only and do not guarantee that any particular medication, formulation, dose, quantity, packaging, pharmacy, laboratory, or service will be available or appropriate for you.

If there is any inconsistency between information displayed through the GobyMeds website or platform and instructions, labeling, documentation, or information provided by a participating provider, independent medical group, pharmacy, laboratory, collection site, or the medication’s label or packaging, you should follow the instructions, labeling, documentation, or information provided by the applicable provider, medical group, pharmacy, laboratory, collection site, or medication label, and contact the appropriate party with any questions.

To the fullest extent permitted by applicable law, GobyMeds does not warrant or guarantee the accuracy, completeness, reliability, availability, or timeliness of information made available through the website, platform, or any third-party resource linked to or referenced by the website or platform.

Third-Party Websites, Services, and Resources

The GobyMeds website or platform may contain links to, integrate with, or otherwise make available third-party websites, portals, applications, forms, payment processors, identity-verification services, messaging services, shipping carriers, pharmacies, laboratories, collection sites, medical groups, participating providers, vendors, and other third-party resources.

Third-party websites, services, and resources are operated by independent third parties and may be subject to their own terms, privacy policies, notices, consents, instructions, fees, and legal requirements. GobyMeds does not control and is not responsible for the content, availability, accuracy, security, privacy practices, professional services, clinical services, pharmacy services, laboratory services, or business practices of any third party, except to the extent required by applicable law.

The inclusion of a link, integration, reference, or access point through the GobyMeds website or platform does not imply that GobyMeds owns, controls, supervises, endorses, or assumes responsibility for the third party or its services. Your use of any third-party website, service, or resource is at your own risk and may require you to agree to additional terms or consents from that third party.

Suspension and Termination

GobyMeds may suspend, restrict, or terminate your access to the website, platform, account, or related non-clinical services, with or without notice where permitted by applicable law, if GobyMeds reasonably believes that you have violated these Terms, provided false, inaccurate, incomplete, or misleading information, engaged in fraud, abuse, diversion, medication misuse, unauthorized account access, security misconduct, payment misconduct, or conduct that creates legal, regulatory, safety, privacy, security, or operational risk.

GobyMeds may also suspend, restrict, modify, or discontinue access to any website feature, platform feature, service, geographic area, medication offering, laboratory-related service, pharmacy option, laboratory option, or other platform functionality based on applicable law, regulatory requirements, provider-network availability, pharmacy availability, laboratory availability, vendor availability, safety considerations, operational availability, or changes to the GobyMeds business.

Any suspension, restriction, or termination by GobyMeds applies only to GobyMeds’ website, platform, account access, and related non-clinical services. GobyMeds does not control or override the independent clinical judgment, legal obligations, or professional responsibilities of any independent medical group, participating provider, pharmacy, laboratory, or collection site. GobyMeds does not determine whether any participating provider continues or ends a provider-patient relationship or course of treatment.

Suspension or termination of your platform access does not prevent you from seeking emergency, urgent, in-person, follow-up, or other medical care from other healthcare providers. Termination does not affect any rights or obligations that accrued before termination, including payment obligations, cancellation and refund terms, shipping and return terms, consents, disclaimers, limitations of liability, dispute-resolution provisions, or any other provisions that by their nature should survive termination.

Severability; No Waiver

Except as otherwise provided in the “Dispute Resolution; Binding Arbitration and Class-Action Waiver” section, if any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law or modified to the minimum extent necessary to make it valid, legal, and enforceable. If modification is not permitted, the invalid, illegal, or unenforceable portion will be severed, and the remaining provisions of these Terms will remain in full force and effect.

GobyMeds’ failure to enforce any provision of these Terms is not a waiver of its right to enforce that provision or any other provision later. Any waiver must be in writing and signed by GobyMeds.

Dispute Resolution; Binding Arbitration and Class-Action Waiver

Please read this section carefully. It requires certain disputes to be resolved through binding arbitration instead of in court and limits the ability to bring claims on a class, collective, representative, or consolidated basis, except as expressly provided below.

For purposes of this section, “GobyMeds Parties” means GobyMeds and its owners, officers, directors, employees, contractors, agents, parents, subsidiaries, affiliates, successors, assigns, and service providers acting on GobyMeds’ behalf in connection with the website, platform, or GobyMeds’ non-clinical administrative or technology services.

Except as expressly provided in this section, you and GobyMeds agree that any legal claim, dispute, or controversy between you and GobyMeds or any GobyMeds Party arising out of or relating to these Terms, your account, your use of the website or platform, GobyMeds’ non-clinical administrative or technology services, communications with GobyMeds, transactions or orders placed through the platform, or advertising or marketing by GobyMeds will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under the AAA Consumer Arbitration Rules and Mediation Procedures, including any applicable fee schedule, in effect when the arbitration is filed, except as modified by this section.

For purposes of this arbitration agreement, “Dispute” includes claims based on contract, tort, statute, fraud, misrepresentation, consumer-protection law, privacy law, advertising law, or any other legal theory, including claims that arose or involve facts occurring before you accepted these Terms and claims that may arise after termination of these Terms, to the fullest extent permitted by applicable law. “Dispute” also includes threshold questions concerning the formation, applicability, interpretation, or enforceability of this arbitration agreement, except that a court, and not an arbitrator, will decide any issue that this section expressly reserves for a court.

This arbitration agreement applies only to Disputes between you and GobyMeds or a GobyMeds Party. It does not require arbitration of claims solely between you and any independent medical group, participating provider, pharmacy, laboratory, collection site, shipping carrier, or other independent third party, unless that third party has a separate valid arbitration agreement with you or applicable law otherwise permits that third party to enforce this arbitration agreement. Nothing in this section makes GobyMeds responsible for the independent clinical, pharmacy, laboratory, shipping, or other professional services of any third party.

Informal Dispute Resolution

Before either party starts arbitration, the party seeking to arbitrate a Dispute must first send the other party a written Notice of Dispute and participate in a good-faith informal dispute-resolution process, unless the Dispute is filed in small claims court or seeks temporary or preliminary injunctive relief as permitted below.

A Notice of Dispute sent to GobyMeds must be emailed to legal@gobymeds.com or mailed to GobyMeds, 8 The Green #20192, Dover, DE 19901, ATTN: Dispute Notice. A Notice of Dispute sent to you may be sent to the email address, mailing address, or account contact information associated with your account or order.

The Notice of Dispute must include the claimant’s name, telephone number, mailing address, email address associated with the account or order, the name and contact information for counsel, if any, a description of the Dispute, and the specific relief sought.

After a Notice of Dispute is received, you and an authorized GobyMeds representative will participate in an individualized telephone or videoconference to try to resolve the Dispute informally. The conference must occur within forty-five (45) days after the Notice of Dispute is received unless the parties agree otherwise. Counsel may participate, but the individual claimant and an authorized GobyMeds representative must also participate. Multiple claimants may not participate in the same conference unless all parties agree.

If the Dispute is not resolved within thirty (30) days after the informal dispute-resolution conference, or if the conference is not held within sixty (60) days after the Notice of Dispute is received despite the initiating party’s good-faith efforts to schedule and participate, either party may begin arbitration. Any applicable statute of limitations or contractual limitations period will be tolled from the date a complete Notice of Dispute is received until the earlier of: (a) thirty (30) days after the informal dispute-resolution conference; or (b) sixty (60) days after the Notice of Dispute is received.

Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, and court review of an arbitration award is limited. The arbitrator may award the same damages and relief on an individual basis that a court could award to an individual, subject to the limitations in this section and applicable law.

Arbitration Procedures; Fees; Location

Arbitration will be conducted by a single neutral arbitrator selected in accordance with the AAA Consumer Arbitration Rules and Mediation Procedures, except as modified by this section. The AAA’s consumer fee schedule will govern filing fees, administrative fees, case-management fees, and arbitrator compensation. GobyMeds will pay any arbitration fees and costs that the AAA Consumer Arbitration Rules, the AAA consumer fee schedule, or applicable law require GobyMeds to pay. Each party will be responsible for its own attorneys’ fees, expert fees, and costs unless applicable law, the AAA Rules, or the arbitrator’s award provides otherwise.

Unless the parties agree otherwise, or unless the arbitrator determines that an in-person hearing is necessary, the arbitration may be conducted by documents, telephone, videoconference, or other remote means permitted by the AAA Rules. If an in-person hearing is required, it will take place at a location reasonably convenient for you, or at another location selected by the arbitrator in accordance with the AAA Rules and applicable law.

The arbitrator will have authority to resolve the Dispute and award individual relief available in court, subject to these Terms and applicable law. The arbitrator’s award will be final and binding on the parties and may be entered as a judgment in any court of competent jurisdiction. Either party may request a written explanation of the award to the extent permitted by the AAA Rules.

These Terms evidence a transaction involving interstate commerce. The Federal Arbitration Act, 9 U.S.C. § 1 et seq., governs the interpretation and enforcement of this arbitration agreement and any arbitration proceeding. The substantive law identified in the “Governing Law” section applies to the merits of any Dispute, except to the extent preempted by federal law.

If the AAA is unavailable or declines to administer an arbitration, the parties will confer in good faith to select a substitute arbitration provider. If the parties cannot agree, either party may ask a court of competent jurisdiction to appoint a substitute arbitration provider or arbitrator under the Federal Arbitration Act. Any substitute arbitration provider or arbitrator must apply the consumer-arbitration procedures and protections required by this section and applicable law.

Information about the AAA Consumer Arbitration Rules, consumer forms, and consumer fee schedules is available from the AAA.

Exceptions to Arbitration; Court Relief; Jury Waiver

This arbitration agreement does not prevent either party from bringing an individual action in small claims court if the claim is within that court’s jurisdiction and remains in that court on an individual, non-class, non-representative, and non-consolidated basis.

Either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property rights, confidential information, platform security, data security, or to stop unauthorized access, fraud, scraping, misuse of the website or platform, or other conduct that could cause immediate or irreparable harm. Seeking this limited relief does not waive either party’s right to arbitration for the underlying Dispute.

Nothing in these Terms prevents you from filing a complaint with, communicating with, or participating in any investigation or proceeding before a federal, state, or local government agency, regulator, licensing board, professional board, medical board, pharmacy board, laboratory regulator, consumer-protection agency, or law-enforcement authority, to the extent such rights cannot lawfully be waived or restricted.

For any Dispute that proceeds in court rather than arbitration, you and GobyMeds consent to the personal jurisdiction of the state and federal courts located in Delaware, except that small-claims actions may be filed in any small-claims court with jurisdiction and venue over the parties and the claim, and except where applicable law requires or permits a different forum.

To the fullest extent permitted by applicable law, you and GobyMeds knowingly and voluntarily waive the right to a trial by jury in any Dispute that proceeds in court rather than arbitration.

Individual Arbitration; Class-Action and Representative-Action Waiver

Except for the mass-arbitration procedures expressly provided below, and to the fullest extent permitted by applicable law, you and GobyMeds agree that each Dispute must be brought and resolved only on an individual basis. You and GobyMeds may not bring, maintain, or seek relief in arbitration on a class, collective, representative, private-attorney-general, joint, or consolidated basis, and the arbitrator may not conduct or preside over any class, collective, representative, private-attorney-general, joint, or consolidated arbitration unless all parties expressly agree in writing after the arbitration demand is filed.

The arbitrator may award monetary, declaratory, or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim, except to the extent applicable law requires otherwise.

A court, and not an arbitrator, will decide disputes concerning the validity, enforceability, or effect of this class-action, collective-action, representative-action, private-attorney-general-action, joint-action, or consolidated-action waiver, including whether any Dispute or request for relief may proceed on a class, collective, representative, private-attorney-general, joint, or consolidated basis.

If a court finally determines that applicable law prohibits enforcement of any part of this waiver as to a particular Dispute or request for relief, then only that Dispute or request for relief will be severed from arbitration and may proceed in court, unless applicable law requires a different result. All other Disputes and requests for relief must be arbitrated on an individual basis. Any severed court proceeding will be stayed pending final resolution of the individual arbitration to the fullest extent permitted by applicable law.

Nothing in this subsection prevents you or GobyMeds from participating in a class-wide settlement.

Mass Arbitration Procedures

If twenty-five (25) or more arbitration demands of a substantially similar nature are filed against GobyMeds or the GobyMeds Parties by or with the assistance, coordination, or representation of the same law firm, group of law firms, organization, or coordinated group of claimants, the demands will be administered under the AAA Mass Arbitration Supplementary Rules and any applicable AAA consumer mass-arbitration fee schedule, except as modified by this section to the extent permitted by applicable law.

For purposes of this subsection, arbitration demands are “of a substantially similar nature” if they arise out of or relate to the same or similar event, act, omission, practice, policy, advertisement, representation, transaction, product, service, or factual scenario and assert the same or similar legal theories or seek the same or similar relief.

Each claimant in a mass arbitration must satisfy the Notice of Dispute and informal dispute-resolution requirements above and must file an individual arbitration demand that includes information reasonably sufficient to identify the claimant, the account or order at issue if applicable, the facts supporting the claimant’s individual Dispute, and the relief sought. A demand may not be filed on behalf of any person who has not authorized the filing.

The parties agree to cooperate with the AAA in good faith to implement any applicable mass-arbitration procedures, including appointment of any process arbitrator, global mediator, or other administrative neutral; use of staged filing, batching, bellwether, mediation, or other procedures adopted by the AAA; and payment of filing, administrative, process, mediation, and arbitrator fees in accordance with the AAA Rules, the AAA’s applicable fee schedule, this section, and applicable law.

Any disagreement about whether the AAA Mass Arbitration Supplementary Rules or any mass-arbitration procedure applies will be decided by the AAA, a process arbitrator, or other administrative neutral appointed under the AAA Rules, except that a court will decide any issue expressly reserved for a court in this section.

The mass-arbitration procedures are intended only to administer similar individual arbitrations efficiently. They do not authorize class, collective, representative, private-attorney-general, joint, or consolidated arbitration, and they do not permit any arbitrator to award relief except on an individual basis as provided above, unless all parties expressly agree in writing after the arbitration demand is filed or applicable law requires otherwise.

If the AAA determines that the AAA Mass Arbitration Supplementary Rules do not apply, each demand will proceed under the AAA Consumer Arbitration Rules and Mediation Procedures, subject to this arbitration agreement.

If application of the AAA Mass Arbitration Supplementary Rules or any batch, bellwether, staged, or similar procedure delays assignment of an individual arbitration demand to an arbitrator for merits proceedings, any applicable statute of limitations or contractual limitations period for that individual demand will be tolled from the date the demand is properly filed with the AAA until the demand is assigned to an arbitrator for merits proceedings or otherwise resolved, to the extent permitted by applicable law.

Right to Opt Out of Arbitration

You may opt out of this arbitration agreement within thirty (30) days after the date you first accept a version of these Terms containing an arbitration agreement. To opt out, you must send a written notice to GobyMeds by email at legal@gobymeds.com with the subject line “Arbitration Opt-Out” or by mail to GobyMeds, 8 The Green #20192, Dover, DE 19901, ATTN: Arbitration Opt-Out.

Your opt-out notice must include your full name, mailing address, email address associated with your GobyMeds account or order, and a clear statement that you want to opt out of arbitration with GobyMeds. A valid opt-out applies only to the requirement that you arbitrate Disputes with GobyMeds and the GobyMeds Parties. It does not affect any other provision of these Terms or any separate arbitration agreement you may have with an independent medical group, participating provider, pharmacy, laboratory, collection site, vendor, or other third party.

If you do not timely opt out, you will be bound by this arbitration agreement. GobyMeds will continue to honor any valid arbitration opt-out that you submitted under a prior version of these Terms.

Future Changes to this Arbitration Agreement

If GobyMeds makes a material change to this arbitration agreement, the change will apply prospectively and will not apply to any Dispute for which either party sent a complete Notice of Dispute before the effective date of the change.

If you have previously accepted an arbitration agreement with GobyMeds and GobyMeds later makes a material change to this arbitration agreement, you may reject the material change by sending a written rejection notice within thirty (30) days after the effective date of the change to GobyMeds by email at legal@gobymeds.com with the subject line “Arbitration Change Rejection” or by mail to GobyMeds, 8 The Green #20192, Dover, DE 19901, ATTN: Arbitration Change Rejection.

If you validly reject a material change, the version of this arbitration agreement that applied to you immediately before the material change will continue to govern Disputes between you and GobyMeds, unless you had previously validly opted out of arbitration. Rejecting a material change does not create a new right to opt out of arbitration if you were already bound by a prior arbitration agreement and did not validly opt out.

Arbitration Severability; Survival

Except as otherwise provided in the “Individual Arbitration; Class-Action and Representative-Action Waiver” subsection above, if any part of this arbitration agreement is held to be invalid, illegal, or unenforceable, that part will be enforced to the maximum extent permitted by applicable law or modified to the minimum extent necessary to make it valid, legal, and enforceable. If modification is not permitted, the invalid, illegal, or unenforceable portion will be severed, and the remaining portions of this arbitration agreement will remain in full force and effect.

If a court determines that this arbitration agreement as a whole is unenforceable, the Dispute will proceed in a court of competent jurisdiction, subject to all other applicable provisions of these Terms, including any enforceable jury waiver, governing-law provision, limitation of liability, disclaimer, defense, or other contractual limitation.

This arbitration agreement survives termination of these Terms and the closure, suspension, cancellation, or deletion of your account or order history.

Governing Law

Except as expressly provided in the “Dispute Resolution; Binding Arbitration and Class-Action Waiver” section, these Terms and any Dispute between you and GobyMeds arising out of or relating to these Terms, your account, your use of the website or platform, GobyMeds’ non-clinical administrative or technology services, communications with GobyMeds, transactions or orders placed through the platform, or advertising or marketing by GobyMeds are governed by the laws of Delaware, without giving effect to conflict-of-law rules that would require application of another jurisdiction’s law, to the fullest extent permitted by applicable law.

Nothing in these Terms limits any non-waivable rights or mandatory protections available to you under applicable federal, state, or local law, including consumer-protection, privacy, telehealth, pharmacy, laboratory, professional-licensure, controlled-substance, or healthcare laws that apply and cannot be waived by contract.

This Governing Law section applies only to these Terms and Disputes between you and GobyMeds. It does not govern, limit, or alter the independent professional duties, licensure obligations, registration obligations, standard-of-care obligations, scope-of-practice requirements, prescribing obligations, dispensing obligations, laboratory obligations, privacy obligations, or other legal responsibilities of any independent medical group participating in the GobyMeds provider network, participating provider, pharmacy, laboratory, collection site, shipping carrier, or other independent third party.

Court forum and venue for Disputes that are not subject to arbitration are addressed in the “Dispute Resolution; Binding Arbitration and Class-Action Waiver” section.

Order Cancellation Policy

Because orders may involve non-clinical platform processing, clinical review by independent medical groups participating in the GobyMeds provider network or participating providers, laboratory-order coordination, pharmacy processing, medication dispensing, and shipment by independent third parties, cancellation availability depends on the order stage and applicable law.

You may request cancellation by contacting GobyMeds customer support at customersupport@gobymeds.com. A cancellation request is not effective unless and until confirmed by GobyMeds or, where applicable, the independent medical group, participating provider, pharmacy, laboratory, collection site, or other service provider whose action is required to stop the order.

Cancellation Before Clinical Review. If you request cancellation before clinical review has begun and before any laboratory order has been transmitted, testing kit shipped, specimen collected, prescription issued, medication prepared or dispensed, or shipment initiated, GobyMeds will cancel the affected order and issue a full refund of amounts paid to GobyMeds for that order, except as required by applicable law.

No-Prescription / Clinical Non-Approval Cancellation. If you paid for a medication order through the GobyMeds platform and, after clinical review, the applicable participating provider does not issue a prescription, determines that the requested treatment or medication is not clinically appropriate, or medication cannot be dispensed through the platform for reasons not caused by your voluntary cancellation, failure to complete required steps, false or misleading information, payment failure, fraud, misuse, diversion, or violation of these Terms, GobyMeds will cancel the affected order and issue a full refund of amounts paid to GobyMeds for that order. In that circumstance, GobyMeds will not charge or retain a consultation fee or clinical-review fee.

Patient-Initiated Cancellation After Clinical Review. If your order is otherwise able to proceed, but you voluntarily cancel, withdraw, decline treatment, decline to use a prescription, or otherwise stop the order after clinical-review or order-processing costs have been incurred at your request, including after a participating provider has reviewed your information or communicated with you, after a prescription has been issued, or after pharmacy-processing, laboratory, fulfillment, shipping, or other order-related costs have been incurred, GobyMeds may charge, or retain from your refund, a consultation or clinical-review fee of $50, or another amount disclosed at checkout, to the extent permitted by applicable law.

Any consultation or clinical-review fee reflects services furnished by the applicable independent medical group or participating provider. GobyMeds may facilitate collection of that fee but does not provide medical services.

If a participating provider has issued a prescription or laboratory order, or if an independent pharmacy, laboratory, collection site, or other service provider has begun processing the order, GobyMeds cannot guarantee cancellation. GobyMeds may make reasonable administrative efforts to relay a cancellation request, but independent medical groups, participating providers, pharmacies, laboratories, collection sites, and carriers control their own professional, operational, dispensing, testing, fulfillment, and shipping processes.

If medication has been dispensed, packaged, labeled, shipped, delivered to a carrier, or otherwise released by the pharmacy for fulfillment, the medication portion of the order generally cannot be cancelled, returned, exchanged, or refunded except as expressly stated in these Terms or required by applicable law. Laboratory testing, collection, kit, shipping, and other third-party fees may also be nonrefundable once the applicable service has begun, supplies have shipped, or a specimen has been collected or processed, except as expressly stated in these Terms or required by applicable law.

Return Policy

Prescription medications, including compounded medications and temperature-sensitive medications, are not ordinary retail products. Once a prescription medication has been dispensed, packaged, shipped, delivered, or otherwise released by an independent licensed pharmacy, it generally cannot be returned, exchanged, restocked, reused, or refunded, except as expressly stated in these Terms, authorized by the dispensing pharmacy, or required by applicable law.

GobyMeds does not operate a pharmacy and does not make professional pharmacy determinations regarding whether medication may be returned, replaced, reused, quarantined, destroyed, credited, or refunded. Those determinations are made by the dispensing pharmacy or other legally responsible party, as applicable.

Do not send medication, syringes, sharps, needles, alcohol pads, packaging, cold packs, laboratory kits, specimens, or other materials to GobyMeds unless GobyMeds or the applicable pharmacy, laboratory, collection site, carrier, or other service provider specifically instructs you to do so in writing. If medication, supplies, packaging, or a shipment appears damaged, incorrect, contaminated, compromised, tampered with, missing, delayed, warm on arrival, mislabeled, misdelivered, or otherwise defective, contact GobyMeds customer support promptly at customersupport@gobymeds.com and follow instructions from GobyMeds, the dispensing pharmacy, the participating provider, the laboratory, the collection site, or the carrier. Do not use medication that appears damaged, contaminated, tampered with, mislabeled, misdelivered, or not intended for you unless the dispensing pharmacy or participating provider confirms that it is appropriate to do so.

Any replacement, credit, refund, investigation, disposal instruction, or other remedy is subject to the Refund Policy, Shipping Policy, applicable pharmacy or laboratory policy, clinical and safety considerations, and applicable law. This Return Policy does not limit any non-waivable rights you may have under applicable law.

Refund Policy

Refund availability depends on the stage of your order, the services already performed, the third-party costs already incurred, the applicable pharmacy, laboratory, carrier, or service-provider process, and applicable law. Payment for an order does not guarantee that a participating provider will determine that treatment is appropriate, issue a prescription, order laboratory testing, continue treatment, or approve any requested service.

No-Prescription / Clinical Non-Approval Refund. If you paid for a medication order through the GobyMeds platform and, after clinical review, the applicable participating provider does not issue a prescription, determines that the requested treatment or medication is not clinically appropriate, or medication cannot be dispensed through the platform for reasons not caused by your voluntary cancellation, failure to complete required steps, false or misleading information, payment failure, fraud, misuse, diversion, or violation of these Terms, GobyMeds will issue a full refund of amounts paid to GobyMeds for the affected order. In that circumstance, GobyMeds will not charge or retain a consultation fee or clinical-review fee.

Any consultation or clinical-review fee reflects services furnished by the applicable independent medical group or participating provider. GobyMeds may facilitate collection of that fee but does not provide medical services.

Except as provided in the No-Prescription / Clinical Non-Approval Refund paragraph above or as required by applicable law, refunds may not be available for services, costs, or items that have already been provided, initiated, ordered, processed, dispensed, shipped, or incurred, including clinical review, laboratory orders, laboratory kits, specimen collection, laboratory processing, pharmacy processing, medication preparation, dispensing, packaging, labeling, shipping, carrier fees, and other third-party costs.

If you believe there is an issue with your order, shipment, medication, laboratory kit, laboratory service, payment, or other service that may entitle you to a refund, credit, replacement, or other remedy, contact GobyMeds customer support promptly at customersupport@gobymeds.com so that GobyMeds can review the issue and, where appropriate, coordinate with the applicable independent medical group, participating provider, pharmacy, laboratory, collection site, carrier, payment processor, or other service provider.

To evaluate a refund, credit, replacement, or investigation request, GobyMeds or the applicable third party may require information or documentation, such as photographs, packaging, medication labels, lot numbers, tracking information, temperature or delivery information, communications with the carrier, proof of loss, proof of damage, or other information reasonably needed to evaluate the request. Do not return or ship medication, syringes, sharps, needles, laboratory kits, specimens, packaging, cold packs, or other materials to GobyMeds unless GobyMeds or the applicable pharmacy, laboratory, collection site, carrier, or other service provider specifically instructs you to do so in writing.

GobyMeds cannot guarantee a refund, credit, replacement, or other remedy for medication or other items that have been used, partially used, discarded, transferred, resold, misused, stored improperly, handled contrary to instructions, lost after delivery, stolen after delivery, delivered to an incorrect address provided by you, not retrieved from a carrier or hold location, or otherwise compromised after delivery, except as required by applicable law.

Approved refunds will generally be issued to the original payment method when reasonably practicable. Refund timing may vary based on payment processor, card issuer, bank, or other financial-institution processing times. GobyMeds does not refund fees, interest, overdraft charges, currency-conversion charges, or other amounts charged by your bank, card issuer, or payment provider, except as required by applicable law.

This Refund Policy does not limit any non-waivable rights you may have under applicable law.

Shipping Policy

General Shipping Policy

Orders involving prescription medication are fulfilled, dispensed, packaged, labeled, and released for shipment by independent licensed pharmacies, not by GobyMeds. GobyMeds may provide non-clinical administrative and technology services related to order coordination, payment, communications, tracking information, and customer support, but GobyMeds does not dispense medication, package medication, operate a pharmacy, or control pharmacy dispensing decisions.

Shipping availability, timing, carrier selection, packaging, temperature-control measures, signature requirements, delivery options, and delivery restrictions may vary based on the medication prescribed, pharmacy availability, pharmacy judgment, shipping destination, carrier availability, weather, holidays, supply constraints, operational issues, applicable law, and other factors outside GobyMeds’ control.

Shipping times, fulfillment estimates, tracking information, and delivery dates are estimates only and are not guaranteed. Processing or shipment may be delayed due to clinical review, identity verification, age verification, physical-location verification, laboratory testing, medical-record review, prescription review, pharmacy processing, medication availability, temperature-control requirements, payment issues, address issues, carrier delays, weather events, holidays, regulatory requirements, or other operational or legal constraints.

Once a prescription has been transmitted to a pharmacy or a pharmacy has begun processing, preparing, dispensing, labeling, packaging, or releasing an order for shipment, GobyMeds may not be able to cancel the order, delay shipment, change the shipping address, change the carrier, change the delivery method, or redirect the package. GobyMeds may make reasonable administrative efforts to relay requests to the applicable pharmacy or carrier, but GobyMeds cannot guarantee that any requested change will be accepted or completed.

Address Changes and Delivery Responsibilities

You are responsible for providing a complete, accurate, and deliverable shipping address where the medication may lawfully be shipped and where you can promptly receive or retrieve the package. You are responsible for monitoring tracking information, retrieving packages promptly after delivery, following carrier instructions, and storing medication according to instructions from the participating provider, dispensing pharmacy, medication label, packaging, or other materials included with the shipment.

Some medications, carriers, pharmacies, or applicable laws may restrict shipment to certain addresses or locations, including P.O. boxes, package-forwarding services, hotels, temporary addresses, businesses, campuses, military addresses, or locations where delivery cannot be verified. Additional identity, age, address, signature, or delivery verification may be required, including for controlled substances or other medications subject to heightened legal or safety requirements.

If carrier tools are available, you may be able to request delivery updates, delivery holds, pickup at a carrier location, delivery rescheduling, or other delivery-management options directly through the carrier. Carrier tools and delivery-management options are subject to carrier rules and availability. GobyMeds does not control carrier delivery-management systems.

Lost, Stolen, Delayed, Damaged, Warm, or Misdelivered Shipments

If tracking indicates that a package is lost, damaged in transit, delayed, misdelivered, returned to sender, or subject to a carrier exception, contact GobyMeds customer support promptly at customersupport@gobymeds.com. GobyMeds may review the issue and, where appropriate, coordinate with the applicable pharmacy, carrier, participating provider, payment processor, or other service provider.

If a package arrives damaged, opened, tampered with, warm, late, missing contents, mislabeled, addressed to another person, or otherwise appears compromised, do not use the medication unless the dispensing pharmacy or participating provider confirms that it is appropriate to do so. Contact GobyMeds customer support promptly and preserve the medication, packaging, shipping label, cold packs, temperature indicators if any, photographs, and tracking information unless instructed otherwise by GobyMeds, the pharmacy, the participating provider, the carrier, or another legally responsible party.

GobyMeds cannot guarantee a refund, credit, replacement, or reshipment for packages that are stolen after delivery, lost after delivery, delivered to an incorrect or incomplete address provided by you, not retrieved from a carrier or hold location, refused, returned because of your action or inaction, exposed to improper conditions after delivery, or otherwise compromised after delivery, except as expressly stated in these Terms or required by applicable law.

If carrier tracking shows successful delivery with proof of delivery to the address provided, refunds or replacements are generally not available for stolen or missing packages. GobyMeds may, in its discretion and where permitted by applicable law and pharmacy policy, consider a refund, credit, replacement, or reshipment on a case-by-case basis. GobyMeds may require documentation such as a carrier claim, photographs, delivery records, police report, written statement, or other information reasonably necessary to evaluate the request.

Any refund, credit, replacement, reshipment, investigation, or other remedy is subject to the Order Cancellation Policy, Return Policy, Refund Policy, applicable pharmacy policy, carrier policy, clinical and safety considerations, and applicable law.

Licensure and Service Availability

Clinical services accessed through the GobyMeds platform are furnished by independent medical groups participating in the GobyMeds provider network and participating providers, not by GobyMeds. Prescription medications, when prescribed, are dispensed by independent licensed pharmacies. Laboratory services, when ordered, are performed by independent laboratories, collection sites, or other laboratory service providers.

Services are available only where the applicable participating provider, medical group, pharmacy, laboratory, collection site, or other service provider is licensed, registered, certified, or otherwise authorized as required by applicable law, and only where the requested service, prescription, laboratory test, shipment, or other activity is legally permitted.

Your access to services may depend on your physical location at the time of care or service, the requested service, provider licensure or registration, controlled-substance requirements, pharmacy availability, laboratory availability, shipping restrictions, clinical judgment, operational availability, and applicable law.

GobyMeds may request information reasonably necessary to support licensure, registration, service-availability, identity, age, location, payment, shipping, controlled-substance, pharmacy, laboratory, or legal-compliance checks. GobyMeds does not guarantee that any service, provider, pharmacy, laboratory, medication, dose, formulation, test, shipment method, or geographic area will be available to you.

Nothing in this section means that GobyMeds practices medicine, provides medical advice, prescribes medication, dispenses medication, compounds medication, operates a pharmacy, performs laboratory testing, or controls the professional judgment or legal obligations of any independent medical group, participating provider, pharmacy, laboratory, collection site, or other third party.

GobyMeds aims to provide clear information about its role, platform services, pricing, order process, cancellation terms, refund terms, return limitations, shipping considerations, laboratory-related coordination, pharmacy-related coordination, and other material platform policies where reasonably practicable.

Information made available through the GobyMeds website or platform may vary or change based on the service requested, your physical location, participating provider judgment, pharmacy availability, laboratory availability, medication availability, shipping requirements, operational availability, applicable law, and information received from independent third parties.

Nothing in this section guarantees that you are eligible for any service, that a participating provider will prescribe medication or order laboratory testing, that any pharmacy will dispense a medication, that any laboratory service will be available, or that any medication, dose, formulation, price, shipping method, pharmacy, laboratory, collection site, or other service option will be available to you.
